Online poker site Sunpoker.com is planning to sue another online gambling site for appropriating advertising space allegedly belonging to Sunpoker. The ad “space,” auctioned off on eBay, is oddly enough located on a pregnant woman’s stomach.
Sunpoker claims to have placed the auction’s highest bid of $8,900, only to have later lost the bid in favor of another online casino, which placed a bid outside the framework of eBay. Although Elise Harp, whose stomach is the source of this debate, allegedly emailed Sunpoker, congratulating them on winning the bid, she shortly sent another one, informing the online poker site that another company had placed a higher bid independent of eBay, and that she therefore wished to nullify the eBay auction.
Sunpoker, claimed that Harp’s private solicitation of another bidder constitutes a breach of contract. They are also suing the competing online casino site for supposedly using ideas previously conceived by Sunpoker, including bringing Elise Harp to the Daytona 500 as part of the ad campaign, to show off her now famous belly.
